2.User Conduct and Use of the Site.

1. You may use MyFrontPageStory.com, register to become a Member, and create an Account if you are at least eighteen (18) years or older or possess legal parental or guardian consent, are fully able and competent to enter into the terms conditions set forth in these Terms of Use and are otherwise capable of forming legally binding contracts under applicable law. If you register to become a Member, you will provide true, accurate and complete registration information and shall maintain as current and promptly update relevant personal contact information provided to My FrontPage Story.
2. Certain portions of MyFrontPageStory.com and information contained on MyFrontPageStory.com may be accessible only to Members or affiliates, service providers, or other business partners of My FrontPage Story, or otherwise may be password restricted. You agree not to gain or attempt to gain unauthorized access to such portions of MyFrontPageStory.com or to information contained in such sections of MyFrontPageStory.com, to obtain or attempt to obtain confidential, proprietary and/or personal information stored on MyFrontPageStory.com, to distribute passwords to unregistered or unauthorized users, or to make any unauthorized use of MyFrontPageStory.com or information accessible on MyFrontPageStory.com. 4. Notwithstanding the foregoing, however, My FrontPage Story makes no representation or guarantee that your story and User Submission will be read by anyone who visits the website, and My FrontPage Story makes no guarantee with respect to the results of any reading or consumption.
6. You agree to use MyFrontPageStory.com for lawful, noncommercial purposes only, and shall not use MyFrontPageStory.com content for purposes of creating, developing or promoting any enterprise, whether or not for profit. You agree to comply with all federal, state, and local laws applicable to the use of MyFrontPageStory.com and to not use MyFrontPageStory.com to engage in prohibited conduct. Broadly stated, “prohibited conduct” is any conduct (i) that is unlawful, infringing, tortious, fraudulent, abusive, harassing, or otherwise harmful to My FrontPage Story or any other party or property; (ii) that violates another party’s intellectual property, privacy or other rights; or (iii) that otherwise interferes with the operation, use or enjoyment of any service, system or other property. By way of illustration, prohibited conduct includes, but is not limited to, using MyFrontPageStory.com or the services provided through MyFrontPageStory.com to (i) violate any law or applicable regulation; (ii) violate or attempt to violate the security or integrity of, or gain or attempt to gain unauthorized access to, this Website or any service, system, information or communication contained herein; (iii) interfere with another’s use of MyFrontPageStory.com or the services provided on MyFrontPageStory.com through the posting or transmitting of a virus or other harmful item; (iv) “spoof” or otherwise impersonate any other party, falsely stating or otherwise misrepresenting your identity or affiliation in any way, use an IP address not assigned to you, forge, delete or alter any part of TCP/IP packet header or sender identification information in any communication; (v) commit fraud; (vi) harass, or threaten any party, advocate or otherwise encourage violence against any government, organization, group, individual or property, or provide instruction, information, or assistance in causing or carrying out such violence; (vii) disseminate viruses, Trojan horses, or other code or programming intended to damage, interfere with, intercept or expropriate any system, data or personal information; (viii) send or receive any material that could be considered harmful, obscene, pornographic, indecent, lewd, violent, abusive, profane, insulting, threatening, tortious, harassing, hateful or otherwise objectionable in My FrontPage Story’s discretion; (ix) send or receive any material that harasses, victimizes, degrades, or intimidates an individual or group of individuals on the basis of religion, race, ethnicity, sexual orientation, gender, age, or disability; (x) send or receive material containing defamatory, false, or libelous material; (xi) send or receive any material that infringes or violates any intellectual property or other right of any entity or person, including, without limitation, copyrights, patents, trademarks, laws governing trade secrets, rights to privacy, or publicity; (xii) post, send, or receive any material that you do not have a right to make available under law or contractual or fiduciary relationships; (xiii) engage in conduct that would expose My FrontPage Story or its affiliates or service providers to civil or criminal liability; (xiv) post, send or otherwise disseminate advertising or any solicitation; (xv) conduct or forward surveys, contests, pyramid schemes, or chain letters; or (xvi) assist others in engaging in prohibited conduct. 7. You acknowledge and agree that you are responsible for all content posted, published, displayed or transmitted to MyFrontPageStory.com by you, including, but not limited to, User Submissions. You agree not to transmit or otherwise make available on MyFrontPageStory.com any content or any personal information of any individual or any material protected by copyright, trademark, publicity, privacy or other intellectual property or proprietary right without the express permission of such individual or the owner of such rights. The burden of determining that transmission of the information is permissible, or that the material is not protected by such rights, is on you, the user. You agree that you will not submit any User Submission that you do not have a right to make available under law or contractual or fiduciary relationships. In the event that any third party consent is required in order to grant to My FrontPage Story the rights described in these Terms of Use, you assume all liability and responsibility for securing any such consent. You are solely liable for, and shall indemnify and hold My FrontPage Story harmless for, any damages resulting from any infringement of copyrights, trademarks, proprietary rights, broadcast rights, violation of privacy or publicity rights, or any other harm resulting from your User Submissions or other submitted content or transmissions to or from MyFrontPageStory.com.
8. My FrontPage Story is not responsible for, or in any way associated with, content posted on or transmitted to MyFrontPageStory.com by users, including, but not limited to, User Submissions. Although My FrontPage Story has no responsibility for content or User Submissions and has no obligation to monitor content posted on or transmitted to MyFrontPageStory.com, My FrontPage Story reserves the right to monitor such content for any reason, and, in its sole discretion, to decide whether content or a User Submission is appropriate and complies with these Terms of Use, to remove any content or User Submission, and/or terminate a user’s access at any time, without prior notice. My FrontPage Story also reserves the right to disclose data to law enforcement agencies or other authorities who may investigate reports of misuse or abuse of MyFrontPageStory.com. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate or otherwise objectionable, and you agree to waive and hereby do waive, any legal or equitable rights or remedies you have or may have against My FrontPage Story with respect thereto, and agree to indemnify and hold My FrontPage Story harmless to the fullest extent allowed by law regarding all matters related to your use of MyFrontPageStory.com, whether as as a customer or interviewee in submitting User Submissions and/or creating a profile, or as a representative of a workplace, media or other institution using MyFrontPageStory.com for screening or publishing purposes. 10. You agree to cooperate fully with My FrontPage Story to investigate any suspected or actual activity that is in breach of these Terms of Use.

4.Copyright Matters and Copyright Agent.

1. All content available at MyFrontPageStory.com, such as text, graphics, logos, icons, images, audio clips, video clips, and/or other content, is the property of My FrontPage Story or used by My FrontPage Story with the permission of the owner of such content and is protected by U.S. and international copyright law. The compilation (meaning selection,composition, and arrangement) of all of the content on MyFrontPageStory.com is the exclusive property of My FrontPage Story and protected by U.S. and international copyright law. Users of MyFrontPageStory.com agree to not take any action with respect to content of MyFrontPageStory.com that would violate the intellectual property or proprietary rights of My FrontPage Story or other third parties, or the individual rights of other users. Content contained on MyFrontPageStory.com may not be modified, copied, distributed, framed, republished, downloaded, displayed, or sold in any form or by any means, in whole or in part, without My FrontPage Story’s prior permission. You may download a copy of any portion of MyFrontPageStory.com, including User Submissions, solely for the purposes of personal, non-commercial use, or for evaluating an athlete for recruiting purposes, provided that all copyright and other notices are kept intact. 2. My FrontPage Story respects the intellectual property of others and asks that its users do the same. You acknowledge and agree that My FrontPage Story may (i) remove content and/or User Submissions that infringe or are believed to be infringing the intellectual property or proprietary right of My FrontPage Story or any third party; (ii) deny access to MyFrontPageStory.com to any user who uses the My FrontPage Story network in violation of any intellectual property or other proprietary right; and/or (iii) terminate a Member’s account who infringes or is believed to be infringing the intellectual property, proprietary, or other rights of any third party
3. In accordance with the Digital Millennium Copyright Act of 1998 (see 17 U.S.C. 512(c)(3) for further detail), My FrontPage Story will respond promptly to claims of copyright infringement that are reported to our Copyright Agent, designated below. If you are a copyright owner or an agent thereof and believe that your work has been copied in a way that constitutes copyright infringement, please report your notice of infringement to My FrontPage Story by providing our Copyright Agent with the following information in writing:

(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

(iv) Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;

5.Intellectual Property Rights.

1. My FrontPage Story Content. Excluding the User Submissions, My FrontPage Story owns all right, title and interest, including without limitation all intellectual property rights, in and to MyFrontPageStory.com and content contained therein (and any derivative works or enhancements of any of the foregoing), developed in whole or in part by, with or for My FrontPage Story. All trademarks, service marks and logos contained on MyFrontPageStory.com (the “Marks”) are the property of My FrontPage Story and its affiliates and/or licensors and may not be copied, imitated, or used without the prior written permission of My FrontPage Story. You shall not acquire any right, title or interest in any content or Mark, except for the limited use rights expressly set forth in these Terms of Use.
2. Restrictions. Content on MyFrontPageStory.com, including User Submissions, is provided to you AS IS for your information and personal use only, and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners, except as expressly permitted herein. If you download or print a copy of the content for a permissible use, you must retain all copyright and other proprietary notices contained therein. 8.Indemnity.

You agree to defend, indemnify and hold harmless My FrontPage Story, its affiliates, its officers, directors, employees, successors, agents, affiliates, distribution partners from and against any and all claims, liabilities, losses, damages, obligations, costs and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with: (i) your use of and access to MyFrontPageStory.com; (ii) your User Submissions or any materials in any form that are provided by you or through use of your account; (iii) any actual or alleged violation or breach of these Terms of Use or any My FrontPage Story policies. This defense and indemnification obligation will survive this Agreement and your use of MyFrontPageStory.com.

You further release and hold My FrontPage Story harmless from any and all liability arising from any misuse, unauthorized access, disclosure, alteration, or destruction of Website content, User Submissions, and/or information contained in MyFrontPageStory.com by other users or third parties.

9.Term and Termination; All Payments Non-Refundable.

1. My FrontPage Story may terminate your Account or block your access to MyFrontPageStory.com immediately upon notice if: (i) you have failed to comply with any of the terms or conditions of these Terms of Use or any policies established by My FrontPage Story; (ii) you have failed to timely make any payment due to My FrontPage Story in connection with your Account; or (iii) My FrontPage Story reasonably suspects that you may be otherwise misusing MyFrontPageStory.com or that your actions may be illegal or cause liability, harm or disruption for you, other users of MyFrontPageStory.com, My FrontPage Story or MyFrontPageStory.com.
2. If you become a Member, you may terminate your account by logging into your Account, editing your profile to delete your Account, and paying any and all fees or other amounts outstanding with respect to your account.
3. Any suspension, termination or cancellation shall not affect your obligations to My FrontPage Story under these Terms of Use (including but not limited to ownership, indemnification and limitation of liability), which by their sense and context are intended to survive such suspension, termination or cancellation.
4. All payments for services hereunder are final and non-refundable.
5. As per the email receipt you receive upon purchasing a My FrontPage Story and as noted in the FAQ section, all sales are final.

10.Miscellaneous.

1. Governing Law. Any disputes arising out of or related to the use of MyFrontPageStory.com or these Terms of Use will be governed by the law of the State of Pennsylvania, regardless of conflict of law provisions. Sole and exclusive jurisdiction and venue over any dispute arising out of or relating to use of MyFrontPageStory.com or these Terms of Use shall lie in the appropriate federal or state court in Dauphin County, Pennsylvania.
2. Severability. The invalidity or unenforceability of any provision of these Terms of Use will not affect the other provisions hereof, and these Terms of Use will be construed and remain in full force and effect in all respects with such invalid or unenforceable provisions limited or excluded to the minimum extent required under applicable law.
3. Entire Agreement.These Terms of Use represent the entire agreement between My FrontPage Story and you with respect to use of MyFrontPageStory.com.
4. Limitation on Causes of Action. Any cause of action you may have with respect to use of MyFrontPageStory.com must be commenced within one (1) month after the claim or cause of action arises.

b. What happens if you miss a phone interview

• If you order the phone call interview, you will get one 10-15 minute phone interview. This can either be conducted with you or another interviewee of your choice. You will receive an initial email from one of our writers in which you will be able to use the calendar link provided to choose a time slot.
  • Please adhere to that time slot. We will call you, but if you do not hear from us within 5 minutes of when your interview was supposed to start, then please give us a call.
  • If we cannot reach you during your chosen time slot, you will get one reschedule of your interview.
    • If you let us know beforehand that you cannot make your interview, that will not count against your one reschedule.
    • If you miss your rescheduled interview as well, then we will have to charge you for an additional phone interview if you want to reschedule yet again.

c. What happens if you don’t receive an email from us

• Check your spam. Some spam filters do not let us get past for some reason.
• Once you place your order, whatever email you used will receive the order receipt, so if you paid and did not receive that, check your spam folder and go and mark those emails as not spam.
• Unless it is the weekend or a holiday, you should typically hear from us within a 24-48 hour timeframe. If you do not, check your spam first, and then email nathaniel@myfrontpagestory.com if need be to find out what is going on.

d. Breakdown of what each package includes

• Basic story
  • This story is 400-700 words and includes quotes from at least one person.
  • We can include quotes from more than one person in the basic story, but 700 words is a hard cap for these stories.
• Plus story
  • This story is 700-1,000 words and includes quotes from at least two people.
  • You can stick with quotes from just one person, but the option for a second full email interview is included in this package.
  • As with the basic story, we can include quotes from more than the listed number of people, but 1,000 words is a hard caps for these stories and the amount of quotes from each person will fall in line with that.
• Deluxe story
  • This story is 1,000-plus words and includes quotes from at least three people.
  • You can stick with quotes from just one person, but the option for one or two more full email interviews is included in this package.
  • As with the basic and plus stories, we can include quotes from more than the listed number of people, but we typically hard cap these stories at 1,250 words and the amount of quotes from each person will fall in line with that.
• Basic web story
  • This is only the story written and sent as a word document.
  • If you want to include a photo or two that is fine, but it will simply be added to the word document.
  • With all packages, however, you have the option of having your story published on our website, so you have the opportunity of having more than just a story written up in a word document.
• Newspaper design
  • This is the most popular add-on that we offer. Once we receive feedback from your first draft as well as photos, we will make changes, design your story and send you the finalized JPEG to your email. No further changes can be made at that time.
• More than 7 Days
  • This is the option for you if you are in no rush to receive your story. We make it a point to try and get all stories written within 7-10 days of receiving all the quotes and information.
  • You may receive your draft in less than 7 days or more than 10 days, but the likelihood is that first draft will hit your email inbox by the 10th day (not going by business days).
• Within 7 Days
  • This option guarantees that as soon as we receive all the information from all parties involved (in terms of quotes from people), your story will be written within a 7 day timeframe.
  • This does not mean that if you get your story shipped that it will arrive within 7 days (although we still work to make this the case as much as possible), but the first draft is guaranteed, and the designed version typically is as long as we get your feedback and photos in time.
• Phone Call Interview

  • Worried that we won’t have enough information without a phone call interview? Don’t fret it.
  • As a matter of fact, since we can only jam pack so many questions in a 10-15 minute interview, it will be best to fill out the post-payment form no matter what. They will give us the most sufficient information, and as long as you answer the questions thoroughly, it will give us plenty to write the story.
• Delivered Electronically
  • You will always receive a finalized version of your story to your email inbox. No matter what add-ons, or lack thereof, you order, you will receive a final version of the story in your email.
    • For all orders with the Newspaper Design, your final electronic copy will be a JPG.
    • For all orders with the Basic Web Story, your final electronic will be a word document.
• Print (Includes Shipping and Handling)
  • At the same time of sending you your final JPG to your email inbox, we will also be sending your story to the printer. No changes can be made once this happens, which is why it is vital that you send us all the changes you want made, as well as making it known which photos you want in your story if you send more than 5.
  • Your story will be printed on a nice 13×19 page and will arrive in a square mailing tube.
  • When we print your shipping label, you should automatically receive tracking information to your inbox. If you do not, please check your spam.
• Framed Print (Included Shipping and Handling)
  • At the same time of sending you your final JPG to your email inbox, we will also be sending your story to the printer. No changes can be made once this happens, which is why it is vital that you send us all the changes you want made, as well as making it known which photos you want in your story if you send more than 5.
  • Your story will be printed on a nice 13×19 page, placed in a black wood frame with a glass front and will arrive in a corrugated shipping box.
  • When we print your shipping label, you should automatically receive tracking information to your inbox. If you do not, please check your spam.

e. What should I do if my package comes damaged?

• Unfortunately, when shipping anything you run the risk of your package arriving in anything but perfect condition. If your print comes creased, bent or torn or your frame comes shattered or either the print or the frame look like they got damaged during the shipping process, please send an email to nathaniel@myfrontpagestory.com.
• You will want to have pictures ready to send so we can file a claim with UPS or USPS. At the same time, once we receive those photos, we will work on getting you a new print and/or frame (whichever you ordered in the first place) sent at no additional cost.

f. What should I do if my package arrives late?

• Unlike with damaged packages, we cannot do too much about a package arriving late. Even if we pay extra for expedited services, that does not always guarantee anything. That said, if you are in the minority of people who receive their package past the occasion, we apologize.
• That is also why we send you the finalized design, however, as there are things that are beyond our control, but it at least gives you something to gift them for the occasion.

g. What should I do if I lost my form?

• If you click the save and continue later button on your after-payment form but cannot find it in your email inbox, please check your spam. If you cannot find it in spam, please email nathaniel@myfrontpagestory.com to see if we have it on file.
• If you forget to put your email address after clicking the save and continue later button and then click send, then unfortunately the form will be lost.
• Also, as a note, any form that has not been worked on for 30 consecutive days will disappear. So make sure you pay attention to that and do not let it get close to the expiration date.

h. What should I do when I receive my first draft?

• First of all, your first draft will come as a word doc no matter what. Pictures and everything else will be added after getting feedback on your first draft
• Second off, we will not proceed past this point of the order until we hear back from you on your draft. If you get your draft and do not want to make changes, let us know that. If you do want to make changes, either send back a word doc with track changes or with the changes made yourself, or let us know your proposed changes in the body of your email.

i. Is the first draft the only draft I can make changes to?

• Yes. We ask that you send all changes at once so we know what all we need to tweak on our end. After that, we cannot make any more changes to the writing portion of your story.

j. Can I submit more than 5 photos?

• The short answer is yes.
• The long answer is that we would not recommend sending more than 5. If you send more than 5 photos and do not make note of which ones you for sure want in the story, you run the risk of having certain photos you might not have preferred over others in the story. We might wind up choosing a photo because of the way it fits in the story instead of because of who is in the photo since we do not necessarily know who is who. So, it is better to send no more than 5 photos so you do not receive the designed version of your story and wish that some of the photos could be swapped out or rearranged.

k. What should I do if I can’t get the right size print for my story?

• You have a couple options here:
  • 1. Upgrade to the printed version of your story.
  • 2. If you go get it printed somewhere, you can ask them to print something that is similar in size. We leave some white space on the edges of the story, so that will allow for resizing without cutting anything off.

l. I decided I want to upgrade my package. Now what?

• No problem! Just let us know what you want to upgrade on your package and we will be happy to invoice you for it.

m. I decided I want to downgrade my package. Now what?

• Unfortunately we cannot downgrade your package. If you decide you don’t want everything you ordered, we cannot take items away.
